Members share their health and their routines.
Joining forms, injury questions, attendance and payments all say something about a person. Members expect you to protect it, and so do the apps that run your bookings. A clear notice and a careful consent process cover most of the risk.
Fitness forms ask about health
Injury, medical conditions and pregnancy questions are health data. The pack shows how to ask only what you need and how to obtain explicit consent.
Bookings go through apps
Class booking and payment tools see names, attendance and sometimes health notes. The checklist shows what to verify with each.
Memberships linger
Members join, freeze and leave, but their records stay behind. Retention guidance covers what to keep for billing and contract reasons and what to delete.
Three parts. One careful approach to member data.
Each part stands on its own and also points to the next: the member notice explains your forms, the tool checklist covers your apps and the retention rules close the loop.
Member data & health information
Ask what safety needs, and no more.
- Joining form and privacy notice for members
- Health questionnaire wording and explicit consent
- Keeping health notes separate and limiting who can see them
Class booking tools
Know who sees your members.
- What to verify with each tool: DPA, data location, transfer mechanisms
- Questions to ask before you connect a tool to member data
Retention of membership records
How long to keep what, and what to do afterwards.
- How long to keep contracts, payments and attendance
- Notes on national differences
- When to delete or anonymise, including after a member leaves
Real wording, not a table of contents.
Two short excerpts from the pack. Highlighted fields are the parts you fill in for your own studio.
Health information for your safety
Before you train with us we ask a few questions about your health, such as injuries and medical conditions, so that we can plan exercise safely. We ask for your explicit consent to record your answers, which only your trainer and the studio manager can see. You can say no or withdraw your consent at any time, although we may then be unable to offer some activities safely.
We keep your answers for [retention period] after your membership ends. Questions can be sent to [contact email].
The full pack explains when consent is the right basis and when another condition applies.
Membership management
| Purpose | Sign up members, take payments, record attendance and manage access |
|---|---|
| Legal basis | Art. 6(1)(b), performance of the membership contract |
| Data subjects | Members and prospective members |
| Categories | Name, contact details, payment details, attendance records |
| Recipients | Booking tool, payment provider, accountant |
| Retention | [period] after the membership ends, then delete |
Health questionnaires are recorded separately, with stricter access.
These are shortened starting points. Your own notices and records must reflect what you actually do, and national rules vary. The pack shows you where to check.
Who it's for, and who it isn't.
A good fit if you
- Run a gym, fitness studio or personal training business
- Collect health questionnaires or injury information from members
- Use a class booking or membership app
- Have no in-house privacy counsel
Not enough on its own if you
- Offer physiotherapy or medical treatment (see the Clinic & Wellness Compliance Pack)
- Use fingerprint, face or other biometric entry systems
- Track members with wearables or health devices at scale
- Need a signed, lawyer-reviewed contract; the pack is not legal advice
Three parts. One payment.
Everything on this page, delivered together. Adapt it to your business, update your notices and answer the next question from the same documents.
- Member data & health information
- Class booking tools
- Retention of membership records
Before you ask —
Who is the Fitness Studio & Gym Compliance Pack for?
Gyms, fitness studios and personal trainers in the EU that hold member data and health questionnaires and use class booking tools, and want a clear, documented way to handle them.
What do I receive?
Three parts: member data and health information wording, a class booking tool checklist and retention guidance for membership records. You get your download page straight after checkout, with no account to create.
Is a fitness health questionnaire health data?
Yes, answers about injuries, conditions or pregnancy are health data, a special category under Article 9. Explicit consent is the usual route for a fitness studio, but national law varies. The pack gives consent wording and shows how to limit access.
Can I keep ex-members' data?
Only as long as you have a valid reason, such as contract or accounting rules, or a claim you may need to defend. After that it should be deleted or anonymised. The retention guidance helps you set periods and leaves the national figure for you to confirm.
Is this legal advice?
No. The pack is a practical starting point. The wording and records are drafts you adapt to how you really work, and national rules vary. Have a qualified lawyer review anything you rely on.
What if it isn't what I expected?
